The petitioner was appointed as the Ticket Seller-cum-Conductor in Calcutta Tramways Company (1978) Limited (in shot "CTC") now known as West Bengal Transport Corporation Limited (n short "WBTC"). The petitioner says that most of the employees appointed in the same rank that of the petitioner has been regularised since 2010. The petitioner is seeking regularisation of his service. The petitioner says that he has made a representation on 17th March, 2022. This representation is not yet disposed of.

The matter either can be heard after inviting affidavit from the respondents or by directing the representation of the petitioner to be considered by the competent authority.

After hearing the parties and considering the materials on record, I find that to get the views of CTC now known as WBTC so far as the petitioner's regularisation is concerned, it will be convenient to

direct the respondent no.2 to dispose of the petitioner's representation dated 17th March, 2022 by a reasoned order after giving the petitioner an opportunity of hearing within a period of four months from date. The reasoned order that may be passed shall be immediately communicated to the petitioner.

The respondent no.2 shall deal with all the issues raised in the representation and shall not be influenced in any manner by any observation made in this order while dealing with the petitioner's representation since I have not entered into the merits of the petitioner's case.

The parties shall act on the basis of a server copy of this order without insisting upon production of a certified copy thereof.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
