The petitioner is directed to serve a copy of the revisional application upon Ms. Manisha Sharma, who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned authorities.

The present application is for expeditious disposal of NDPS Case No. 182 of 2022 arising out of Sagarpara Police Station Case No. 187 of 2022 dated 17.08.2022.

Learned Advocate appearing for the petitioner submits that the petitioner was arrested on 17th August, 2022 and the investigating agency on completion of investigation submitted charge sheet in the month of January, 2023. The learned Special Court framed charges on March 2023 and the next date has been fixed on 16.06.2023. It has been submitted that there are 13 witnesses, out of which majority of the witnesses belong to the government department and the others are independent witnesses. The petitioner is in custody for about 10 months. The learned Special Court has taken efforts for progressing with the case as the date has been fixed on 16th June, 2023. I direct that the learned trial court would fix a schedule of three dates

and fix the schedule on regular intervals as it deems fit and proper for conclusion of trial consisting of 13 witnesses to be examined within a reasonable period of time. Unnecessary adjournment should not be granted to either of the parties. In case any witness is reluctant to appear before the learned Special Court, it would communicate with the office of the Superintendent of Police, Murshidabad, who is maintaining a register for the progress of trial of NDPS Act. The Public Prosecutor conducting the trial will produce the materials, exhibits and the documents on the date so fixed for examination of the witnesses. Efforts be taken by all stakeholders by cooperating with the trial court for completing the trial at the earliest stage.

With the aforesaid observations, CRR No. 2068 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this court. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. ( Tirthankar Ghosh, J. )
