The charge is under Section 12 of the POCSO Act read with Sections 341/326/307/354D of the Indian Penal Code. The petitioner says that there was an affair between him and the victim girl who was about 15 years old at the time of the alleged incident. He has been falsely implicated in this case. He has no involvement in any offence. He is in custody for about 5 months. He prays for bail.

Learned advocate for the State vehemently opposes the prayer. He draws our attention to the injury report. The injury is grievous. He also shows us the statement of the victim girl recorded under Section 164 Cr.P.C. who clearly implicates the petitioner.

In view of the aforesaid incriminating evidence against the petitioner and the seriousness of the alleged crime, we are not inclined to enlarge the petitioner on bail, at this stage. Signed By :
