Shaw ..........for the petitioner Mr. Bhaskar Prasad Vaisya Mr. Sagnik Chatterjee ..........for the State In this writ petition the prayer is made for consideration of the representation made by the writ petitioner to the Commissioner of School Education, Government of West Bengal, for transfer on special ground.

On perusal of the writ petition and after hearing the learned advocate, Mr. Anjan Bhattacharya, appearing on behalf of the writ petitioner, it appears that the writ petitioner, being an Assistant Teacher of Ratiakocha Junior High School, Purulia, preferred the representation dated 4th January, 2021 to the Commissioner of School Education, Government of West Bengal, for transfer on special ground without obtaining "no objection" from the school concerned. Therefore,

Mr. Bhattacharya submits that the writ petitioner does not want to proceed with the writ petition since there is necessity to obtain "no objection" from the concerned school authority before the representation of the writ petitioner is considered by the the Commissioner of School Education. Accordingly, prayer is made to permit the writ petitioner to withdraw the writ petition with liberty to file afresh after obtaining necessary "no objection" from the school concerned.

Such prayer of the writ petitioner is not opposed by Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader, representing the State respondents.

The writ petition is dismissed as withdrawn with liberty to file afresh, after obtainment of "no objection".

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
