1. Heard learned Counsel for the parties.
2. It is fairly submitted at the Bar that the injuries sustained by the victim are simple in nature. Investigation is stated to have progressed substantially.
3. In view of the nature of offence, we do not find any need of custodial interrogation of the petitioner.
4. Regard being had to such facts and submissions, factum of permanent residence of the petitioner and substantial progress in the investigation, it is directed that the petitioner shall be released on bail in the event of his arrest by the Arresting Officer on such terms and conditions as deemed just and proper in the facts and circumstances of the case in Connection with Keshiary Police Station Case No. 105 of 2023 dated 22.03.2023 including the conditions that i) the petitioner shall appear before the I.O. once in a week on the day and time fixed by the I.O. till the submission of Final
Form; ii) the petitioner shall not threaten, induce or coerce any witness of this case including the victim in any manner whatsoever; and iii) on his appearance before the I.O., the petitioner shall give an account of his activities during the last seven days within 21 days of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O along with a copy of this order.
5. Accordingly, the prayer for the anticipatory bail is allowed.
