Kalyani Ghosh @ Sandhya Ghosh v. State Of West Bengal
01.07.2022.
23.
Ct.No.28 as (Rejected) C.R.M. (DB) 2084 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bhimpur P.S. Case No.92 of dated 07.03.2022 under Sections 498A/304B/120B/201/34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
In the matter of : Kalyani Ghosh @ Sandhya Ghosh. ... Petitioner.
Mr. Prabir Majumder.
...for the Petitioner.
Mr. Saswata Gopal Mukherjee, ld. P.P., Mr. Partha Pratim Das, Mrs. Manasi Roy.
...for the State.
Heard the learned Advocates appearing for the parties. Petitioner is the mother-in-law of the victim housewife. She is in custody for about 105 days. She prays for bail. Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record. Victim housewife was burnt at the matrimonial home. Petitioner was present at the place of occurrence. She does not stand on the same footing with co-accuseds who were not present at the place of occurrence and were granted bail in CRM (DB) 1656 of 2022.
Keeping in mind the incriminating materials on record and the prima facie involvement of the petitioner therein, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner is rejected.
