Sk Saif Uddin v. State Of West Bengal
14.12.2021.
as (Rejected) C.R.M. 5828 of 2021 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Belda P. S. Case No.39 of 2021 dated 01.02.2021 under Sections 498-A/302/304-B/34 of the Indian Penal Code.
In the matter of : Sk. Saif Uddin.
... Petitioner.
Mr. Kaushik Dey.
...for the Petitioner.
Mr. Abhra Mukherjee, Ms. Manisha Sharma.
.....for the State.
Heard the learned Advocates appearing for the parties. It is submitted on behalf of the petitioner that he is the uncle-in-law of the deceased housewife. He has been falsely implicated in the instant case.
Learned Advocate appearing for the State opposes the prayer for anticipatory bail.
We have considered the materials on record including the statements of witnesses which show that the petitioner had incited other accused persons to set the housewife on fire.
In view of the prima facie role played by the petitioner in the alleged crime and the gravity of the offence, we are not inclined to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
