Notice has already been served upon the respondent authorities and the copy of the same is submitted in Court, let the same be kept on record. The matter is listed today at the instance of the petitioner.

Mr. Bari, learned advocate appears for the writ petitioner and submits that, vide order dated 5th December, 2023 the writ petition has been disposed of. The Court has allowed the writ petition by setting aside memos dated 9th September, 2020 and 28th September, 2020 and also directing the respondents to return a sum of Rs. 3,56,164/- to the petitioner, within the stipulated period.

Mr. Bari has sought for incorporation of a clarificatory sentence in the order that re-fixation of pension of the writ petitioner in terms of "Acategory" scale of pay be immediately made by the respondent authorities along with payment of differential value of pension, pursuant to such refixation as per "A category" scale of pay.

Considering the facts of the case as well as the order of this Court dated December 5, 2023, let the respondent authorities be directed further for refixation of pension of the writ petitioner in terms of "A-category" scale of pay be immediately made by the respondent authorities along with payment of differential value of pension pursuant to such refixation as per "A category" scale of pay. Let this order be part and parcel of this Court's earlier order dated 5th December, 2023. (Rai Chattopadhyay, J.)
