Considered the material on record.
It appears that the name of the petitioner has transpired from the statement of a co-accused. No other witness has implicated the petitioner in the alleged offence. It is trite law that statement of a coaccused is not admissible in the eye of law. Considering the material on record and extent of complicity of the petitioner in the alleged crime, this Court is inclined to grant anticipatory bail to the petitioner.
Accordingly in the event of arrest, the petitioner namely Umar Faruk @ Faruk Sk. be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the learned jurisdictional Court and pray for regular bail within two weeks from date. The application for anticipatory bail is disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
