Writ petitioner is the examinee of 10+2 examination conducted by the Central Board of Secondary Education (CBSE) in 2021.

Writ petitioner could not participate in practical examination in three subjects, namely, English Core, Business Studies and Mathematics since the writ petitioner at the relevant point of time was suffering from Covid-19. Subsequently, the writ petitioner was allowed to participate in practical examination in those three subjects which was conducted by Bethany Mission School, Raiganj, Uttar Dinajpur. It further appears from the writing dated 10th August, 2021 issued by the Principal of Bethany Mission School, Raiganj, Uttar Dinajpur, that the marks awarded to the petitioner in practical examination in those three subjects have already been forwarded to the concerned authority of CBSE. Petitioner prays for publication of revised

marksheet based on her performance in practical examination in those three subjects.

Mr. Menon, learned advocate appears on behalf of the CBSE authorities and submits that in the event the marks of practical examination has been forwarded by the school authority there is no difficulty in issuing revised marksheet containing the marks obtained by the writ petitioner in practical examination.

On considering the submissions made on behalf of the writ petitioner and the CBSE authorities the writ petition stands disposed of thereby directing the respondent nos.1 & 2 to issue revised marksheet in favour of the writ petitioner containing the marks which has already been awarded in favour of the writ petitioner in other subjects including the marks obtained by her in practical examination in three subjects as aforesaid within a period of fortnight from the date of receipt of original marksheet. Before issuance of revised marksheet writ petitioner is required to surrender her original marksheet which has been issued by the CBSE authorities and writ petitioner is directed to take steps immediately for surrendering the said marksheet.

With the above direction, the writ petition

stands disposed of.

There shall be no order as to costs.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
