The petitioners pray for expeditious disposal of the pending applications filed in connection with Title Suit No.27 of 2019 which is pending before the learned Civil Judge (Senior Division), Chandannagore and upon disposal of the applications, it is further prayed that the suit be disposed of as well.

It is submitted that an application for injunction has been filed by the plaintiffs, which is pending disposal. An application for rejection of plaint filed by the petitioners is also awaiting disposal.

Thus, without going into the merits of the pending applications and the pending suit and without expressing any opinion as to which application should be decided first, this revisional application is disposed of with a direction upon learned court below to dispose of the pending applications within a period of three month from the next date fixed, without granting unnecessary adjournments to either of the parties. Thereafter, the suit shall be expedited and disposed of within a year.

An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite parties is not required. The prayer is innocuous.

It is made clear that the application shall be taken up as per the seriality which the learned court deems fit and proper and in terms of the earlier orders already passed by the learned court below. The learned court below shall proceed in accordance with law and independently. Accordingly, the revisional application is disposed of. However, there will be no order as to costs.

Petitioners are directed to serve a copy of the revisional application upon the opposite parties, along with the server copy of this order.

Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
