The petitioner is aggrieved by the fact that the private respondents are disturbing peaceful enjoyment of his land.

Counsel for the private respondents submits that they are co-owners along with the petitioner. The petitioner denies the same and submits that he purchased the property from the original co-owner. The petitioner has lodged a complaint with the Pathar Pratima Police Station but in vain. The petitioner complains of inaction on the part of the police. This Court notes that the disputes between the petitioner and the private respondents are civil in nature and the police have no role to play in deciding the mutual right and title of the petitioner and the private respondents in respect of the land in question.

The petitioner may take out appropriate civil proceedings in accordance with law.

Pathar Pratima Police shall, however, ensure that there is absolutely no breach of peace in the area and shall maintain a strict vigil at the locale.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
