Banerjee) Mr. Amitava Mukherjee, Sr. Advocate Ms. Arpita Saha Ms. Antara Das ...for the petitioner This application under 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court at Alipore to dispose of Title Suit No. 726 of 2023 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.

From the order-sheets appended to this application this court finds that May 15, 2025 was fixed for hearing of the application under Order 39 Rule 1 and 2 of the Civil Procedure Code. It further

appears from the order dated May 15, 2025 that a recall petition was taken up for hearing. The same was heard in part and July 2, 2025 has been fixed for further hearing of the recall application.

In view thereof, CO 2068 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), 2nd Court at Alipore to make an endeavour to dispose of the recall application as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the recall application, the learned trial judge is requested to make an endeavour to dispose of the application under Order 39 Rule 1 and 2 of the Civil Procedure Code as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
