1. Heard learned Counsel for both the parties.

2. The basis of implication of the present petitioner in the offence alleged is the statement of the co-accused from whom the alleged arm is stated to having seized. The investigation is stated to have progressed substantially.

3. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, nature of evidence and substantial progress in the investigation, it is directed that the petitioner shall be released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case in connection with Islampur P.S. case No. 100 of 2023 dated 12.03.2023.

4. Within 3 weeks of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O. alongwith a copy of such order.

6. Accordingly, the prayer for the anticipatory bail is allowed.
