Susama Pramanik @ Sarkar and others Mr. Dibyajyoti Raha Mr. Pritam Mukherjee Ms. Arpita Saha ... for the petitioner The petitioner is the plaintiff in Title Suit No.1255 of 2015, pending before the learned Judge, 10th Bench, City Civil Court at Calcutta. The petitioner prays for expeditious disposal of the suit. It is submitted that after the defendant no.2 expired, the legal heirs of the said defendant were substituted and direction was passed by the learned court below for filing written statement by the substituted heirs.

It is further submitted that the suit is in the peremptory board and unless the directions are passed for expeditious disposal of the suit, unnecessary harassment would be caused to the plaintiff.

Under such circumstances, this court is of the view that justice would be subserved if the learned court below is directed to dispose of the Title Suit No.1255 of 2015, expeditiously.

This court has not gone into the merits of the suit. An order of expeditious disposal of any litigation enures to the benefit of all the parties.

Hence, prior service of this revisional application upon the opposite parties would not be necessary. The prayer is innocuous.

The revisional application is disposed of with direction to the learned court below to make all necessary endeavour to dispose of the title suit within a period of one year from the next date fixed, without granting any unnecessary adjournments to either of the parties.

Petitioner is directed to serve a copy of this revisional application along with the server copy of this order, upon the opposite parties.

Accordingly, the revisional application is disposed of.

All the parties are directed to act on the basis of the server copy of this order.
