Allegation against the petitioners is under Section 35(3) of the Electricity Act, 2003. It appears that final assessment of the dues have been made on 8th June, 2026. The petitioners undertake to deposit fifty per cent of the finally assessed amount before the authority within ten days from date.

Learned counsel for the State submits that the petitioners have complied with the notice under Section 35(3) of the BNSS. In view of the above, prayer for anticipatory bail is allowed. In the event of arrest, the petitioners namely Md. Haider Ali and Shama Khatoon be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions laid down under Section 482(2) of the BNSS and subject to further condition that the petitioners shall deposit fifty per cent of the finally assessed amount within ten days from date as undertaken by them. The petitioners shall appear

before the learned jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
