This is an application seeking expeditious disposal of a proceeding in Sessions Case No.16/2023 arising out of Sashan Police Station Case No.13/20 dated 14.02.2020 under Sections 326/307/302 of the Indian Penal Code, presently pending

before the learned Additional Sessions Judge, 5th Court, Barasat, North 24 Parganas.

Mr. Suman De and Mr. Aniket Mitra, learned counsels, who ordinarily appear on behalf of the State, are requested to represent the State in this matter. Their engagements may be regularised by the concerned authority. Copy of the application is served on them.

Learned counsel for the petitioner submits that the petitioner is the de facto complainant in this case. He lodged an FIR on 14.02.2020. A charge-sheet was submitted on 03.07.2021. However, till date even charges could not be framed. The proceedings remain pending for no fault of the petitioner.

Learned counsel for the State submits that the State would not come in the way if a direction is passed to expedite the proceedings.

No prejudice will be caused to anyone if the proceeding is expedited.

It appears that there has been inordinate delay in conducting the proceeding, especially in not having the question of framing of charge decided after commitment of the case in 2022.

In view of such special circumstances, the learned trial court is directed to conclude the proceeding as expeditiously as possible, more particularly to decide the question of framing of charge expeditiously, preferably within a period of six months from the date of communication of this order. With these observations and directions, the revisional application is disposed of.
