Ali Ahasan ...for the private respondents The petitioner complains that the private respondents are disturbing his possession in respect of a plot of land being JL No. 106, Mouza Jestha Bhabanipur, Plot No. 4818, Khatian No. 6515, Area 02 satak, over which he has built a mud house. The petitioner claims that he has acquired the said land under the West Bengal Acquisition of Homestead Lands for Agricultural Labourers, Artisans and Fishermen Act, 1975.

It appears from the records, that by an order dated March 4, 2021 passed in Appeal Case No. 158 of 2016, the collector and D.L. & L.R.O., Birbhum acting under Section 19 of the said Act of 1975 had directed reversion of the land to the original owners, i.e., one Abdur Rashid. Therefore,

neither the petitioner nor the private respondents have any right, title or interest in the said land. In view of the above, no relief can be granted to the petitioner.

The writ petition shall stand dismissed.

There shall be no order as to costs.

The report of the Officer-in-Charge, Nalhati Police Station, Birbhum, dated 20.09.2021 is kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
