The writ petitioner is a teacher who retired on superannuation on 28th February, 2018. There were two pension payment orders issued one on 9th February, 2018 and another on 21st December, 2020. Though it has been submitted by Ms. Khutia (Bhunya), learned advocate appearing for the petitioner that revised pension payment order was issued in terms of ROPA 2019 Rules therefore, the petitioner is entitled to receive interest on delayed payment of revised gratuity but on perusal of paragraph 5 of the writ petition as well as the prayer couched in this writ petition, it appears that statements are made relating to release of revised pension in terms of ROPA 2009 Rules.

It has been rightly pointed out by Mr. Basu, learned advocate representing the State that no amount is due and payable as on date in terms of

the Revision of Pay and Allowance of Rules, 2009. Therefore, the writ petition does not merit consideration and the same stands dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
