Banerjee) Mr. Subhankar Nag Mr. Nikhil Jhunjhunwala ...for the petitioner Mr. Joydip Kar, Sr. Advocate ...for the opposite parties This application under Article 227 of the Constitution of India is at the instance of the Syama Prasad Mookerjee Port and is directed against an order being no. 3 dated March 10, 2025 passed by the learned District Judge in-Charge, South 24 Parganas, Alipore in PP Appeal No. 6 of 2025. By the order impugned the appeal was admitted and an order of stay of operation of the judgment dated February 12, 2025 passed in proceeding no. 805 of 2006 was passed subject to condition of payment of monthly occupation charges.

After some argument Mr. Nag, learned advocate appearing for the petitioner submits that he has instruction to pray for a direction for expeditious hearing of the PP appeal.

Mr. Kar, learned Senior Advocate appearing for the opposite parties submits that the opposite parties

do not have any objection if the PP appeal is heard expeditiously.

Mr. Nag, learned advocate appearing for the petitioner submits that November 4, 2025 has been fixed for hearing of the said appeal.

It appears from the order-sheets that April 10, 2025 was fixed for appearance of the parties before the learned Additional District Judge 16th Court at Alipore before whom the appeal stood transferred. Learned advocates for the respective parties assures this court that the party shall appear before the learned Additional District Judge 16th Court at Alipore on the next date fixed.

In the light of the aforesaid submission made by the learned advocates for the respective parties, CO 2073 of 2025 stands disposed of by requesting the learned Additional District Judge 16th Court at Alipore to make an endeavour to dispose of the PP Appeal No. 6 of 2025 keeping in mind the order passed by this court on May 14, 2025 in a batch of civil revision applications the leading case being CO 1167 of 2024 (S. P. Mookerjee Port -Vs.- Bhagirath Kejriwal & Ors.). (Hiranmay Bhattacharyya, J.)
