On the prayer of the petitioner, liberty is granted to correct the cause title of the application by incorporating the name of the petitioner's father as Late Rajani Kanta Mondal instead of Late Dayamay Mondal.

The grievance of the petitioner is that she is an octogenarian lady and has been possessing the land in question till date.

The State respondents are trying to take possession of the said property though the property has not been acquired in due process of law.

The petitioner prays for a direction upon the State authority not to disturb her peaceful possession in respect of the property and/or to release the property in her favour.

Heard the learned counsels for the parties.

The petitioner is at liberty to file an application before the respondent No.2 ventilating her grievance

alongwith all relevant documents within two weeks from date. Respondent No.2 is directed to consider and dispose of the said application after affording an opportunity of hearing to all the affected parties including the petitioner within three months from the date of receipt of the application, in accordance with law. WPA 13901 of 2021 is disposed of. There will be no order as to costs.

As affidavits have not been invited, the allegations made in this writ petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
