By an order dated 10th April 2017, a coordinate Bench in WP No.9000 (W) of 2017 in Faijuddin Mondal Vs. The State of West Bengal and Ors. directed the respondents to reverse and refund a sum of Rs.4,79,480/- wrongfully deducted towards overdrawal by the writ petitioner from his pensionary benefits. The order has not being complied with.

Counsel for the State submits that the writ petitioner himself on the directions of the respondents deposited a sum of Rs.3,35,006/- and Rs.1,44,474/- via two separate TR Forms with the Berhampore Treasury. In that view of the matter, the respondent Nos.3 and 4 shall ensure refund of the aforesaid two sums of money to the writ petitioner, within a period of one month from the date of communication of a copy of this order.

The District Inspector of Schools (SE), Murshidabad, shall make an appropriate communication to the concerned treasury based on this

order and the concerned treasury shall transmit the funds to the writ petitioner's bank account, particulars whereof shall be given by the writ petitioner to the concerned treasury office.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
