Mr. Ram Anand Agarwal Mr. Ananda Gopal Mukherjee Ms. Sonam Roy ..... For the writ petitioners/ respondents Records reveal that a writ petition being WPA 9680 of 2022 was preferred by M/s. Sonai Food Marketing Private Limited and another challenging, inter alia, an order dated 23rd May, 2022. By an order dated 10th December, 2024, the writ petition was disposed of quashing the said order.

The State and its functionaries thereafter preferred a recalling application.

Upon contested hearing, the said recalling application was dismissed by an order dated 11th April, 2025. Challenging the said order the State and its functionaries have preferred the appeal being MAT 878 of 2025.

Similarly, M/s. Sonai Food Marketing Private Limited and another preferred a writ petition being WPA 9712 of 2022 challenging, inter alia, an order dated 20th May, 2022. The said writ petition was also allowed by an order dated 10th December, 2024 quashing the impugned order dated 20th May, 2022. Challenging the said order the State and its functionaries have preferred the appeal being MAT 879 of 2025.

When both the appeals were taken up for analogous hearing on 18th September, 2025, the appellants sought for liberty to challenge the parent orders passed on 10th December, 2024 passed in the respective writ petitions. The Court adjourned the matter with liberty to the appellants to challenge the parent orders.

Mr. Chatterjee, learned advocate appearing for the appellants informs this Court that the appellants have already preferred two appeals in connection with the said writ petitions challenging the parent orders dated 10th December, 2024 and the same have been registered as MAT 1674 of 2025 and MAT 1675 of 2025.

Such fact has not been disputed by Mr. Mitra, learned senior advocate appearing for the writ petitioners/respondents.

As the State and its functionaries have already preferred independent appeals being MAT 1674 of 2025 and MAT 1675 of 2025 challenging the parent orders dated 10th December, 2024, the present appeals, in our opinion, have become infructuous. In view thereof, the appeals being MAT 878 of 2025 and MAT 879 of 2025 are dismissed as infructuous. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, J.)
