Banerjee) Mr. Tushar Kanti Mukherjee ...for the petitioner This application under 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Jr. Division), at Bidhannagar to dispose of the Title Suit No. 231 of 2004 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

Learned advocate appearing for the petitioner submits that the application under Order 6 Rule 17 of the Civil Procedure Code filed by the defendant/petitioner herein is still pending.

From the order-sheets appended to this application this court finds that January 3, 2025 was fixed for clarification and for further hearing. CO 2078 of 2025 stands disposed of with the hope and trust that the learned Civil Judge (Jr. Division), at Bidhannagar shall make an endeavour to dispose of the application under Order 6 Rule 17 of the Civil Procedure Code filed by the defendant/petitioner herein as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

After disposal of the interlocutory application, the learned trial judge shall make an endeavour to dispose of Title Suit No. 231 of 2004 as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind that fact that the suit is pending since 2004.
