Mr. Ranadeb Sengupta, Mr. Sachit Talukdar, Mr. Tirtharaj Ghoshal ...for the petitioner Mr. Amal Kumar Sen, Addl. Govt. Pleader Mr. Jaladhi Das ....for the State Mr. Sen, learned advocate appearing for the State submits that Suri P.S. Case No.63/2024 dated 06/02/2024 has been investigated and on conclusion of investigation police authorities submitted charge sheet against one accused person. So far as the other accused persons are concerned they have been discharged from case.

Mr. Sengupta, learned advocate appears for the petitioner. As the police authorities have submitted the charge sheet, petitioner would be at liberty to take up the issues which he intends to rely by way of an application under Section 173 (8) of the Code of Criminal Procedure before the jurisdictional magistrate and the application filed by petitioner be disposed of within 45 days of the same being filed. If the petitioner/de facto complainant prays for any document which the prosecution has relied in that

case, learned magistrate would pass necessary orders and would hand over before the hearing in respect of the application under Section 173 (8) of the Code of Criminal Procedure.

With the aforesaid observations, the writ petition being WPA 14384 of 2024 is disposed of. A copy of the charge sheet has been handed over to the learned advocate appearing for the petitioner.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
