Versus

The State of West Bengal & Ors.

Mr. Robiul Islam Mr. Masooq Rahaman ...for the Petitioner Mr. Madhu Jana Ms. Puja Sonkar ...for the State Affidavit of service filed by the petitioner is taken on record.

On prayer of the petitioner, liberty is granted to expunge the names of the respondent nos. 6 and 7 from the cause title of the petition. The cause title be amended accordingly.

Learned counsel for the petitioner submits that the Pradhan of 8 No. Raipur Gram Panchayat was removed pursuant to a requisition notice floated by the members of the Panchayat. Date of meeting for election of a new Pradhan was fixed by the Prescribed Authority on June 04, 2026 by a notice issued on May 25, 2026. The Prescribed Authority, by a notice issued on June 03, 2026 postponed the meeting due to unavailability of police assistance. A further date for the meeting was fixed on June 17, 2026 by a notice issued on June 09, 2026. Again, the date was postponed on the same ground by a notice issued on June 16, 2026. The petitioner seeks a direction upon the

Prescribed Authority to hold the meeting for election of the new Pradhan, with police assistance, if required. Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the meeting for election of new Pradhan has been deferred on two occasions due to unavailability of police assistance as informed to the Prescribed Authority by the Inspector in Charge, Domkol Police Station, the Prescribed Authority and the Block Development Officer, Domkol Block, being the 4th respondent herein, is directed to convene and hold the meeting within 10 days from the date of communication of this order upon service of notice to all concerned.

The Inspector in Charge, Domkol Police Station, being the 5th respondent herein, is directed to render all possible assistance to the 4th respondent so that the meeting can be held peacefully and without any disturbance from any corner whatsoever.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
