1. We have heard the learned advocates for either of the parties.

2. Since the writ petition is disposed of without calling for affidavits and without hearing the respondent nos.11 to 15 i.e. the private respondents, the merits of the allegations made in the writ petition are not gone into.

3. The allegation of the petitioners is that there is an illegal encroachment by the private respondents and filling up the land classified as "Nayanjuly" and illegally the land is being sold to different persons and in this regard, the petitioners state that they have lodged a complaint before the District Magistrate, Malda, namely, the 4th respondent.

4. In the light of the above, without going into the merits of the allegations made in the complaint, we

direct the 4th respondent i.e. the District Magistrate, Malda to enquire into the matter after notice to all concerned and take action in accordance with law as expeditiously as possible preferably within a period of four weeks from the date of receipt of the server copy of this order.

5. With the above observations, the writ petition stands disposed of.
