Vs Sanjay Ketan Sarkar (Through Video Conference) Mr. Sanajit Kumar Ghosh Mr. Madhusudan Mukhopadhyay ....... for petitioners Mr. Sanajit Kumar Ghosh, learned Advocate files fresh Vakalatnama executed by Deputy General Manager (G), Eastern Railway, Kolkata along with a letter dated 16th November, 2021 of Senior Law Officer, Eastern Railway, where he has been directed by the petitioners to withdraw the present case and to file appeal before the appropriate court. At this stage, Mr. Rabindra Nath Bag, learned Advocate appears and submit that he is the lawyer for the petitioners and he may be permitted to make submission, but in view of fresh Vakalatnama filed by Mr. Ghosh on behalf of the petitioners this day, I am unable to hear Mr. Bag. Mr.

Ghosh submits that due to inadvertence the present revisioinal application has been filed instead of appeal against the impugned order dated 7.06.21 passed by the Hon'ble Central Administrative Tribunal, Calcutta Bench. Therefore, he prays that petitioners may be permitted to withdraw the present case with liberty to take back the original certified copy of the impugned order.

Considered. Prayer is allowed. The petitioners are permitted to withdraw the present case and file the same before the appropriate forum. Further permitted to withdraw the original certified copy of the impugned order dated 07.06.2021 passed by the Hon'ble Central Administrative Tribunal, Calcutta Bench, which they have filed along with this revisional application.

Accordingly, C.O. No. 1555 of 2021 is hereby disposed of as withdrawn.

There will be no order as to costs.

Urgent Photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
