Banerjee) Mr. Narayan Prasad Agarwal ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 3rd Additional Court, Alipore, South 24 Parganas to dispose of the injunction application filed in Title Suit No. 105 of 2023 expeditiously.

Learned advocate appearing for the petitioner submits that the injunction application is pending from the year 2023. He further submits that the injunction application is otherwise ready for hearing. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned first appellate court.

From the order-sheets appended to this application this court finds that June 19, 2025 was fixed for hearing of the in junction application. Learned advocate appearing for the petitioner submits that the hearing of the injunction application was adjourned on June 19, 2025 and the next date for hearing of the application has been fixed on August 5, 2025.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 2084 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), 3rd Additional Court, Alipore, South 24 Parganas to take up the hearing of the injunction application on the next date fixed, i.e., on August 5, 2025, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
