The petitioner seeks disposal of his application for return of the seized coal pending before the learned Chief Judicial Magistrate, Purulia in connection with G.R. case no. 2110 of 2023.

The petitioner filed an application for return of the seized coal before the learned trial Court in connection with which the learned trial court called for a report from the Investigating Officer. Report was submitted by the Investigating Officer objecting to such return. By an order passed on 29th February, 2024, learned trial Court perused the report and took the same on record. The application for return of the seized coal was not disposed of.

In view of the above, the revisional application, being CRR 2111 of 2024 is allowed directing the learned Chief Judicial Magistrate to dispose of the application submitted by the petitioner for return of the seized coal in connection with G.R.

case no. 2110 of 2023 upon calling for a fresh report from the Investigating Officer in this regard.

The petitioner is at liberty to submit all relevant documents in support of his prayer before the Investigating Officer within seven days from date.

The learned trial Court shall dispose of the application within a fortnight from the next date of hearing fixed before him, in accordance with law.

Urgent certified website copy of this order, if applied for, be given to the parties, upon compliance of all requisite formalities.
