CRM (A) 2022 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Kandi Police Station Case No.503 of 2024 dated 26.10.2024 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act pending before the Court of the learned Additional District and Sessions Judge, 2nd Court-cumJudge, Special Court under NDPS Act, Murshidabad at Berhampore.

The instant application has been filed with a prayer for anticipatory bail.

This is a case involving recovery of commercial quantity of narcotic i.e., 3200 bottles of phensedyl syrup. 3.

Learned counsel appearing on behalf of the petitioner has submitted that nothing was recovered from the possession of the petitioner but his name was included in the charge sheet only on the basis of statement of the co-accused of this case. 4.

In opposition to that, learned counsel appearing on behalf of the State has referred to the relevant documents in the case diary, particularly CDR involving conversation between the petitioner and the arrested accused in whose possession the huge quantity of phensedyl syrup was recovered.

In these circumstances, I am unable to overcome the legislative hurdle of Section 37 of the NDPS Act and no other option is left but to reject the prayer of the petitioner for anticipatory bail.

The prayer for anticipatory bail is, thus, rejected. 7.

Accordingly, CRM (A) 2022 of 2025 stands disposed of. 8.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 9.

Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
