The respondent no.7, who is the Drawing and Disbursing Officer (hereinafter DDO) of the borrower, has submitted a report in the form of an affidavit, which is taken on record.
2. It appears from the said report that the probable accrued amount on account gratuity, payable to the respondent no.12, who has since retired, is approximately Rs.12 lakhs. There is a provident fund amount in excess of Rs.14 lakh payable to him as well.

The outstanding towards the loan of the petitioner is slightly in excess of Rs.21 lakh.

The respondent no.7 is directed to appropriate a sum of Rs.10 lakh from the gratuity amount payable to the petitioner and thereafter a sum from his pension will be appropriated towards liquidation of the loan. Such sum will be quantified by the respondent no.7 and necessary steps be taken in respect thereof.
5. The respondent no.7 will credit the amount of the
petitioner with a sum of Rs.10 lakh within a period of four weeks from date upon the petitioner furnishing the details of such bank account and other particulars, as may be required for such credit.
6. Upon the liquidation of the entire outstanding amount, the petitioner will inform the respondent no.7, who will thereafter stop such deduction from the pension account payable to the respondent no.12.
7. With the aforesaid directions, the writ petition is disposed of. However, there shall be no order as to costs.
8. Urgent photostat certified copy of this order, if applied for be supplied to the parties upon compliance of all requisite formalities.
