In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

Since the materials annexed and averments made in the application indicate considerable delay in disposal of the suit-in-question, C.O. No.2228 of 2018 is disposed of by requesting the Additional District Judge, Seventh Court at Barasat, District-North 24 Parganas to dispose of Other Suit No.39 of 2006 pending before the said court, along with pending applications, if any, in connection therewith, at the earliest, positively within six moths from the date of communication of this order to the court below. The learned advocate for the petitioner shall communicate this order, along with a server copy, on

the opposite party as well as the court below at the earliest.

The court below shall act on the communication of the learned advocate, along with server copy, without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent website certified copies of this order, if applied for, be given to the parties upon compliance of all formalities.
