Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. No case under Section 313 of the Indian Penal Code is made out according to him.

Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary. There is a medical report of the de-facto complainant suggesting the demise of the embargo. The police complaint was lodged within seven months of the marriage. In view of the materials in the case diary, the gravity of the offence and the involvement of the petitioner therein and in view of the statutory presumption, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 3125 of 2022 is dismissed.
