The petitioner is aggrieved as he received his provident fund dues long after his retirement. He prays for interest on account of delayed payment of his provident fund.

A representation (Annexure P3, p.37) seeking interest made before the District Inspector of Schools (SE), Purba Medinipur is alleged to be pending consideration for a considerable period of time.

As it appears that the petitioner's representation for seeking interest on account of delayed payment of his provident fund is not considered, hence, without entering into the merits of the same, the writ petition is disposed of by directing the concerned DI of Schools to decide the petitioner's representation strictly in accordance with law, but positively within a period of twelve weeks from the date of communication of this order.

If it appears that there has been delay in disbursing the provident fund amount of the

petitioner and the said delay was not attributable to the petitioner, then interest at the rate of 5% p.a. shall be paid to the petitioner from the date the provident fund amount fell due till the date of actual payment without any further delay.

Affidavit of service filed in Court be taken on record.
