Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 143 days. He prays for bail. It is contended co-accuseds have been enlarged on bail. Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record. Statements of witnesses show petitioner/husband had subjected the victim housewife to torture upon demands of dowry. She was driven out from the matrimonial home and committed suicide immediately after she was brought back to the matrimonial home. Allegations against other in-laws are generic and omnibus. Hence, they were enlarged on bail.
Keeping in mind the primary role played by the petitioner/husband in the torture and in view of gravity of the
offence, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
