Learned Advocate appearing for the petitioner submits that in spite of the direction passed by the learned Civil Judge, Junior Division, 3rd Court, Paschim Medinipur in connection with TS No. 379 of 2022, no steps have been taken by the police. Learned Advocate draws the attention that there was a specific direction upon the Officer-in-Charge, Sabang Police Station for police assistance to implement the injunction order restraining the defendants from disturbing the peaceful possession of the plaintiff/the present petitioner.

In view of the specific directions of the learned Civil Judge, Junior Division, 3rd Court, Paschim Medinipur I direct that the Officer-in-Charge of Sabang Police Station will respect, obey and

implement the order of the learned Civil Judge, Junior Division, 3rd Court, Paschim Medinipur. In case there is further disturbance the Officer-in-Charge of Sabang Police Station will assess whether the aforesaid order has been varied, modified by any higher forum. If the same has not been done the police officer concerned will direct the respondents to furnish a bond and impose a condition for staying outside the jurisdiction of Sabang Police Station.

With the aforesaid observations WPA 13322 of 2023 is disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
