CRM (A) 2026 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Mothabari Police Station Case No.279 of 2025 dated 07.04.2025 under Sections 85/117(2)/91/109/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Section 4 of the D.P. Act pending before the Court of the learned Chief Judicial Magistrate, Malda.

And In the matter of : Kohinur Bibi ...... Petitioner Mr. Arup Kumar Bhowmick ... For the petitioner Mr. Sardar Sahin Imam Ms. Sima Biswas ... For the State 1.

The instant application has been filed with a prayer for anticipatory bail.

Learned counsel appearing on behalf of the petitioner has prayed for anticipatory bail of the petitioner who is the motherin-law of the de facto complainant. It is submitted that the husband and the sister-in-law were already enlarged on anticipatory bail in connection with this case. 3.

Learned counsel appearing on behalf of the State has referred to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure (Section 183 of the BNSS) and other documents collected during investigation including the medical reports.

Considering all facts and circumstances, I am not inclined to enlarge the accused petitioner on anticipatory bail. The prayer for anticipatory bail is, thus, rejected. 5.

Accordingly, CRM (A) 2026 of 2025 stands disposed of. 6.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 7.

Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
