None appears on behalf of the respondents.

The petitioner seeks refund of the amount deducted from his terminal benefit on account of overdrawn payment.

It appears from the Pension Payment Order annexed to the writ petition that the petitioner retired from service on 31st October, 2019 and the Pension Payment Order was issued in his favour on 23rd November, 2019. The petitioner has approached this Court in May, 2024 seeking refund of the amount deposited on account of overdrawn salary.

It appears that the petitioner has approached this Court nearly five years after his retirement. There is no explanation as to why the petitioner delayed in approaching this Court. 6.

The prayer of the petitioner for refund at such a delayed point of time cannot be accepted. 7.

The writ petition fails and is hereby dismissed.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
