CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1934 of 2012 In the matter of : Smt. Abha @ Arpita Chakraborty . .....petitioner. In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.
Record of this revisional application reflects that an interim order was passed staying the proceedings before the learned 1st Judicial Magistrate, Basirhat till 6th June, 2013. The said interim order thereafter has never been extended. Record also reflects that the subject matter of the case relates to the proceedings for execution in respect of the orders passed under Section 125 of the Code of Criminal Procedure.
Having regard to the nature of the proceedings and the fact that the interim order is not there for more than 8 years, I am of the view that the revisional application has lost its force by lapse of time. In case the learned Magistrate has not exhausted the proceedings, the same should be done at the earliest.
Consequently, the present revisional application being CRR 1934 of 2012 is dismissed.
All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
