Sk. Yusuf v. State Of West Bengal And ORS.
30.06.2026 Ct. No. 05 adeb WPA 13918 of 2026 Sk. Yusuf Vs.
The State of West Bengal & Ors.
Mr. Uday Sankar Chattopadhyay Mr. Suman Sankar Chatterjee Ms. Trisha Rakshit Ms. Aishwarya Datta Ms. Bidisha Chakraborty Ms. Sadia Parveen Ms. Shreya Banerjee ...for the petitioner Mr. Suryaneel Das Ms. Anita Kundu Ms. Sumita Sarkar ...for the State Mr. Husen Mustafi Mr. Imran Hossain Layek Ms. Rimi Sil ...for the respondent nos. 6 to 10
1. Affidavit of service filed on behalf of petitioner is taken on record.
2. It is submitted by the learned advocate representing petitioner that petitioner is one of the co-accused in a murder case and petitioner was in custody. Petitioner was enlarged on bail on 15th April, 2026 and thereafter lodged two complaints one dated 19th April, addressed to Officer-in-Charge, Galsi Police Station, Purba Bardhaman and another was addressed to the Superintendent of Police, Purba Bardhaman dated 3rd June, 2026.
3. Petitioner prays for direction upon the concerned police authorities for taking necessary steps since it is alleged in the
complaint dated 3rd June, 2026 that house of the petitioner was looted by the villagers.
4. Mr.
Das, learned Additional Government Pleader represents State respondents has filed a communication dated 28th June, 2026 of Officer-in-Charge, Galsi Police Station, Purba Bardhaman and same is taken on record. Copy of the said communication dated 28th June, 2026 is made over to the learned advocates representing petitioner and respondent nos. 6 to 10.
5. On perusal of two complaints dated 19th April, 2026 addressed to the Officer-in-Charge, Galsi Police Station and another complaint dated 3rd June, 2026 addressed to the Superintendent of Police, Purba Bardhaman it appears that contents of these two complaints are contradictory. In the complaint dated 19th April, 2026 mere apprehension was expressed by the petitioner that he may be attacked by local persons, whereas in complaint dated 3rd June, 2026 it was stated that after being enlarged on bail returning home petitioner found that his house was looted. Petitioner was enlarged on bail on 15th April, 2026 whereas first complaint was lodged on 19th April, 2026 wherein there was no whisper that house of the petitioner was looted.
6. However, taking note of the disclosure made in the communication dated 28th June, 2026 by the Officer-in-Charge, Galsi Police Station it appears that there might be discontentment amongst local inhabitants since petitioner is accused in a crime where three local persons died. Apprehension of petitioner being attacked by villagers taking note of the disclosure made in the communication dated 28th June, 2026 cannot be ruled out.
7. Hence, concerned police authorities are directed to provide protection to the petitioner, if occasion so arises.
8. With the aforesaid observations and directions writ petition stands disposed of.
9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
