The learned advocate appearing for the petitioner submits that no overt act has been attributed to the petitioner. The entire case is based upon circumstantial evidence and the petitioner has been roped in only on the basis of suspicion. In the said conspectus, as there is no possibility towards early conclusion of the trial, further detention of the petitioner, who is in custody for 212 days is not warranted. Mr. Sur, learned Additional Public Prosecutor appearing for the State opposes the petitioner's prayer and draws our attention to the statements of the witnesses and the other materials in the case diary. He further submits that a co-accused person, namely, Gopal Bag, who is similarly situated with the petitioner herein, was denied bail by a Coordinate Bench of this Court on 22nd September, 2021. Having heard the learned advocates and considering the materials in the case diary, the gravity of the offence and the extent of complicity of the petitioner, we are not inclined to exercise any discretion in his favour. As such, his prayer for bail is refused at this stage.

The application for bail being CRM No.5730 of 2021 is,

accordingly, dismissed.
