Mr. Mahadeb Sarkar, Mr. Bikash Chowdhury ...for the petititiner Mr. Lalit Mohan Mahata, Mr. Prasanta Behari Mahata ] ...for the State The grievance of the petitioner is directed against non-appointment of the petitioner as an ASHA (Accredited Social Health Activist), despite being eligible for the subject post. It is submitted on behalf of the petitioner that notwithstanding the fact that the petitioner had been selected as a successful candidate for the subject post and ought to have received an engagement letter, the respondent authorities have failed to issue an engagement letter to the petitioner.

On behalf of the State respondents it is submitted upon instructions that the petitioner was a successful candidate in respect of the subject post and should have received an engagement letter.

In view of the submissions made on behalf of the State, W.P.A. No. 13337 of 2023 stands

disposed of by directing the concerned State Authority to issue the engagement letter to the petitioner in respect of the subject post if so entitled in accordance with law.

The above exercise is to be completed within the period of six weeks from the date of communication of this order.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
