Petitioner being a staff of Kharagpur Homeopathic Medial College and Hospital reported that certain persons intended to forcefully occupy the OPD and to that effect informed the police authorities, but till date no action has been taken.

Report has been submitted by the State.

Report of the State as well as the submission made by the learned advocate appearing for the State reflects that there was a dispute between the Management of the College and the employees concerned. Accordingly disputes and differences erupted on several occasions.

Police authorities are in complete seisin of the matter. Subsequently on the basis of a written complaint Kharagpur Town Police Station Case No. 287 of 2024 dated 10.07.2024 has been registered for

investigation under the relevant provisions of law and it is reflected that the present petitioner has been made an accused in the said case.

Having considered that the investigation is going on against the present petitioner, I direct that in respect of the accusations of the petitioner, if the police authorities have not acted upon, petitioner would approach the jurisdictional criminal court under the relevant provisions of law for appropriate relief.

With the aforesaid observations WPA 14446 of 2024 is disposed of.
