The petitioner renews his prayer for bail which was initially rejected on merits by a Coordinate Bench by an order dated May 10, 2022, passed in CRM (DB) 1224 of 2022. Thereafter, a couple of applications of the petitioner were also rejected on the ground that the first rejection was on merits. The petitioner says that he is now in custody for more than two years and four months. Only 8 out of 23 witnesses have been examined.

Learned State Advocate says that the next schedule for examination is fixed on September 18, 2024. Learned Advocate says that all endeavors will be made to ensure an early conclusion of the trial.

We have considered the material on record. There does appear to be some incriminating material against the petitioner. However, we cannot lose sight of the fact that he has been in detention for a long period of time.

Accordingly, we direct the learned Trial Court to expedite the trial to the utmost and conclude the same as early as possible and definitely within a period of six months from the next date fixed for recording of evidence.

It is made clear that if the trial is not concluded within the time period indicated above, the petitioner will be at liberty to renew his prayer for bail.

CRM (DB) 1656 of 2024 is, thus, dismissed.
