Affidavit-of-service filed on behalf of the petitioner is taken on record.

Learned advocate representing the petitioner submits on previous two occasions applications for transfer was made by the petitioner, first on the ground of distance and second on medical ground since wife of the petitioner was suffering from ailments. However, based on both the applications recommendation was never made by the West Bengal Central School Service Commission for petitioner's transfer.

It is submitted in connection with first application which was made on the ground of distance seeking transfer, school authority where petitioner is presently working did not forward the transfer application to the

concerned District Inspector of Schools (S.E.) since petitioner did not come within the zone of consideration considering his seniority.

However, it is submitted at present five teachers have joined the school and there is augmentation of teaching strength in the school in question.

Leave is prayed for to permit the petitioner to apply afresh for transfer on the ground of distance in between the present school of the petitioner and his place of residence.

Hence, writ petition stands disposed of granting leave to the petitioner to make application, in accordance with law, seeking transfer.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
