1. Heard learned Counsel for the parties.

2. Perused the report submitted by the I.O., Detective Department, Bidhannagar Police Commissionerate which learned State Counsel placed today in Court.

3. After hearing learned Counsel for both the parties, we are of the view that in view of the nature of allegation and alleged offence, custodial interrogation of both the petitioners is necessary, though the principal accused is stated to have been released on regular bail in the meantime.

4. Regard being had to such facts and submissions, we do not deem it just and proper to exercise our discretion in favour of the petitioners under Section 438 Cr.P.C. at this stage.

5. Accordingly, the prayer for the anticipatory bail is rejected.

6. The application being CRM (A) 2253 of 2023 is dismissed. (Chitta Ranjan Dash, J.) (Apurba Sinha Ray, J.)
