Mr. Kishore Dutta, Mr. Ratul Das, Mr. Subhajit Roy ... for the petitioner Mr. Nilotpal Chatterjee, Mr. Amrita Lal Chatterjee ... for the State The petitioner has challenged an order dated 6th May, 2022 passed by the West Bengal State Rural Development Agency debarring the petitioner from participating in any tender under the concerned authority and the Panchayats & Rural Development Department, Government of West Bengal for a period of six months. The six months expired on 6th November, 2022.

Learned counsel appearing for the State hands up a Notification dated 5th April, 2023 issued by the Panchayats & Rural Development Department, Government of West Bengal, which states that the debarment of some of the agencies/contractors

including the petitioner stands withdrawn with effect from 6th November, 2022.

Learned counsel appearing for the petitioner seeks to challenge the Notification dated 5th April, 2023 on the ground that the Notification confirms the fact of debarment.

Upon considering the prayers in the writ petition, this Court is of the view that nothing further remains in the writ petition to be adjudicated. The petitioner shall, however, be at liberty to challenge the Notification dated 5th April, 2023 and the Debarment Order dated 6th May, 2022, if the petitioner is so advised.

WPA 13113 of 2022 is accordingly disposed of in terms of the above. Interim orders, if any, shall stand vacated.
