The writ petition is disposed of with a direction upon the Officer-in-Charge, Dum Dum Police Station to conclude the investigation started on the basis of the complaint lodged by the petitioner, namely, Dum Dum Police Station Case No. 500/2022, dated July 6, 2022, under Sections 341/323/506 of the Indian Penal Code read with Sections 24 and 25 of the Maintenance and Welfare of Parents & Senior Citizens Act, 2007.

It is the specific contention of the petitioners that the respondent no. 5 being the elder son of the petitioners, has been continuously torturing the petitioners and have tried to obstruct the petitioners from selling the house and the shop.

The police authorities shall continue a vigil, to ensure that no disturbance is caused to the petitioners.

The learned advocate for the respondent no. 5 specifically submits before the court that the allegations of torture are false and frivolous. That the respondent no. 5 did not ever obstruct the petitioners from selling the house and the shop. It has been specifically submitted before this court that no disturbance will be created in case of any sale of the property, of which the petitioners are exclusive owners.

The writ petition is accordingly disposed of with a direction upon the police authorities to keep a vigil and maintain peace and tranquility.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
