The petitioner who is the Pradhan of Nimtita Gram Panchayat has challenged the requisition notice submitted by the members of the Panchayat/the private respondents on 9th June, 2026 primarily on the ground that the notice is in violation of Section 12(2) and 12(3) of the West Bengal Panchayat Act, 1973.

It appears from the affidavit submitted by the private respondents that the requisition notice was sent to the petitioner at the Gram Panchayat office as well as at her residential address and returned with an endorsement 'Refused'. Such refusal amounts to good service. The requisition notice demonstrates that copy of the notice has been forwarded to the petitioner.

On being satisfied that the notice conforms to the requirements of sub-section (2), the Prescribed Authority issued notice upon the parties fixing the date of meeting on 24th June, 2026.

The requisition notice having been submitted in compliance of Section 12(2) of the Act of 1973 and the notice of meeting being issued in terms of Section 12(3) of the Act, there is no infirmity, irregularity or illegality in the same which requires interference by this Court. The writ petition is dismissed.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
